The Asamblea de Condóminos (Condominium Owners' Assembly) is the supreme governing body of a condominium in Mexico, where all unit owners meet to approve budgets, maintenance fees, rules and major decisions that affect the property. Defined in Quintana Roo's Condominium Property Law, Article 2, Section IV, as the highest administrative body that governs the organization and social functioning of the condominium regime.

How it works

In Quintana Roo condominiums, ordinary assemblies must be held at least every six months to approve annual budgets, review expenses, elect the administrator and oversight committee, and set or adjust maintenance fees. Extraordinary assemblies address urgent matters such as major repairs, special assessments or bylaw changes. The administrator convenes the assembly with at least 15 calendar days' notice (or longer if the bylaws specify), posted in five visible locations within the condominium. First-call quorum requires owners holding 75 percent of the total undivided ownership share; second call requires 51 percent; third call proceeds with whoever attends. Votes are weighted by each owner's percentage of the undivided share, except when electing or removing the administrator or oversight committee, where each residential unit receives one vote regardless of size. Since the 2021 reform, owners may participate remotely via video with equal legal standing. All decisions bind every owner, including those absent or opposed, and are recorded in official minutes that form part of the condominium's legal record. Foreign buyers should review at least two years of assembly minutes (actas) before purchase to identify pending litigation, deferred maintenance, planned special assessments or rule changes that could affect costs or use of the property.
