How it works
When a foreign buyer purchases a condo in Quintana Roo, the deed specifies both the private unit and the buyer's proportional share (indiviso percentage) of the common areas—pools, lobbies, gardens, elevators, hallways, parking lots, gyms and rooftops. These areas cannot be sold, rented or seized separately from the private unit. All owners pay monthly HOA fees (cuota de mantenimiento) to maintain them; in Quintana Roo these fees average higher than the national MXN 2,900 due to resort-style amenities, ranging from approximately MXN 500 per month in large developments (500+ units) to MXN 3,800 in smaller buildings (1-50 units) as of November 2026. The condominium assembly (asamblea de condóminos) approves the annual budget and any modifications to common areas require assembly consent. Some spaces may be designated "common area of exclusive use" (área común de uso exclusivo)—such as an assigned parking space or terrace—meaning the owner holds exclusive use rights but the area remains co-owned by all, governed by the reglamento.
