Comisión is the fee paid to a real-estate agent or agency for services in a property sale or rental transaction in Mexico. PROFECO (Federal Consumer Protection Agency) guidance states that commissions on property sales generally range from 5 to 6 percent of the sale price, with 6 percent being the most common rate.

How it works

In Mexico, the seller typically pays the commission at closing, calculated as a percentage of the final sale price plus 16 percent IVA (value-added tax). The standard commission rate for property sales is 5 to 6 percent excluding IVA, with 6 percent being the most common according to PROFECO. On a MXN 3,000,000 property with a 6 percent commission, the seller pays MXN 180,000 commission plus MXN 28,800 IVA, totaling MXN 208,800. When two agents are involved—one representing the seller and one the buyer—the commission is typically split 50/50. For long-term rental transactions, commissions usually equal one month's rent plus IVA for a one-year lease. Commissions are negotiable in Mexico, with no fixed legal rate, though large franchises tend to maintain firm rate schedules. Flat-fee platforms and independent agents may charge lower rates, typically 5 to 6 percent plus IVA according to PROFECO guidance.
