How it works
In Quintana Roo, the condominium law requires the constitutive deed (escritura constitutiva) to describe parking spaces assigned to each unit. Parking spaces assigned in the deed are integral to the owner's exclusive-use right and cannot be sold, leased or attached separately from the unit. There are three legal classifications: private property (escriturado separately with its own deed), common area with exclusive use (assigned to a unit in the deed but remains common property), and shared common area (no specific assignment). If the deed shows boundaries and assigns a specific space, it is exclusive use; if it only mentions a right to park without defining limits, it is shared common area. Standard dimensions are 2.4 meters wide by 5 meters long (12 square meters). Foreign buyers should verify in the escritura whether parking is included, how many spaces, and the legal classification, because spaces not titled or assigned offer no exclusive right and reduce resale value.
